1. Introduction and Acceptance of Terms
Welcome to the website of Americare Appliance and HVAC Solutions (“Americare,” “we,” “us,” or “our”). By visiting, browsing or submitting a request through https://www.americareappliance.com/ (the “Website”), you agree to these Terms and Conditions (the “Terms”). If you do not agree, please do not use the Website.
Americare provides appliance repair, HVAC repair and service, installation and replacement, and maintenance memberships to residential and commercial customers in New York and Florida. These Terms apply to everyone who uses the Website or requests our services through it.
2. Use of the Website
You may use the Website only for lawful purposes and in line with these Terms. You agree not to:
- Submit false, misleading or fraudulent information in any form, booking request or review.
- Use the Website to harass, threaten or harm others, or to send spam or unsolicited promotions.
- Attempt to gain unauthorized access to the Website, its servers or any connected systems.
- Introduce viruses, scrapers, bots or other code intended to disrupt or copy the Website.
- Copy, resell or exploit any Website content for commercial use without our written permission.
We may suspend or restrict access to the Website at any time, without notice, if we believe these Terms have been broken.
3. Services, Scheduling and Estimates
Service requests. Submitting a request on the Website is not a confirmed appointment. A booking is confirmed only when an Americare representative confirms the date, time and details with you by phone, text or email.
Same-day visits. Same-day service is available only when you call us between 8 AM and 5 PM and a technician is available. Requests made outside those hours, or when no technician is available, will be scheduled for the next available time.
Emergency service. Our 24/7 emergency HVAC line is for urgent situations. Emergency availability may vary, and after-hours or emergency rates may apply. We will tell you about any such rates before dispatching a technician.
Diagnostic fees. Our appliance diagnostic is not free. A diagnostic fee applies and will be quoted before the visit.
Estimates. Any estimate we provide is based on the information available at the time. Final pricing may change if the technician finds additional issues, parts needs or site conditions. We will explain any change and get your approval before doing additional work.
Your responsibilities. You agree to provide safe and clear access to the equipment, make sure an adult (18 or older) is present during the visit, and tell us about any known hazards, such as gas smells, electrical issues or pets that may affect the visit. We may decline or stop work if conditions are unsafe.
4. Maintenance Memberships and Promotional Offers
Americare offers two separate memberships: an HVAC Membership and an Appliance Repair Membership. Each has its own benefits, which are described on the Website and in your membership agreement.
Promotions. From time to time we offer limited-time promotions, including a free one-year membership. Promotional offers are available for a limited period, while the promotion is active, and are subject to additional conditions. Conditions apply. Please check the membership page for full details before relying on any offer.
General membership terms.
- Memberships are non-transferable and have no cash value.
- A membership term is one year from the date of activation unless stated otherwise.
- Memberships cover only the services and equipment listed in the membership details.
- We may change, replace or end a promotional offer at any time before you enroll.
- Customer may cancel the membership before the first paid charge or at any time thereafter. Americare will provide a simple cancellation method, including an online/electronic method when enrollment occurred electronically. Cancellation will stop future recurring membership charges after the effective cancellation date, subject to applicable law. Amounts already properly charged for an elapsed billing period are not refundable except where required by law.
5. Pricing, Payment, Cancellations and Warranty
Pricing. Prices shown on the Website are for general information and may change without notice. The price that applies to you is the one we quote and you approve before work begins.
Payment. Payment is due upon completion of service. We accept cash, card or cheque payment. Unpaid balances may be subject to late fees or collection costs.
Cancellations and rescheduling. Please give us at least 24 hours notice to cancel or reschedule an appointment. A cancellation or missed-appointment fee may apply if you cancel late or are not available at the scheduled time.
Warranty. Labor performed by Americare is warranted for 30 days for labor from the service date. Parts are covered by the manufacturer’s warranty, where one applies. The warranty does not cover damage caused by misuse, accidents, power surges, unauthorized repairs or normal wear.
6. Intellectual Property, Third-Party Links, Privacy and Communications
Intellectual property. All content on the Website, including text, logos, graphics, images, videos and design, belongs to Americare or its licensors and is protected by copyright and trademark laws. You may view and print pages for personal, non-commercial use only.
Third-party links. The Website may link to other websites. We do not control those sites and are not responsible for their content, policies or practices.
Privacy. Your use of the Website is also governed by our Privacy Policy. It explains what personal information we collect and how we use it.
Calls and text messages. By giving us your phone number or email, you agree that Americare may contact you about your service request, appointment, membership and, if you opt in, promotions. Message and data rates may apply. You can opt out of texts at any time by replying STOP, and you can ask us to stop marketing calls or emails by contacting us at the details below.
Use of artificial intelligence in our communications. Americare may use artificial intelligence (“AI”) tools, including automated or AI-generated voice calls, text messages, emails, chat assistants and virtual agents, to contact you, respond to your inquiries, schedule appointments, send reminders, follow up on service requests and share information about our services and offers. By providing your contact details and consenting to be contacted, you agree that these communications may be made, written or delivered in whole or in part using AI.
- Disclosure. Where required by law, we will tell you when you are speaking with an automated or AI system. You may ask at any time to speak with a member of our team.
- Consent and opt-out. Your consent to receive AI-assisted calls or messages is not a condition of purchasing any service. You can withdraw consent at any time by replying STOP to a text, telling the caller or assistant you do not want further contact, or contacting us at the details below. We will honor opt-out requests within the time required by law.
- Accuracy. AI-generated communications are provided for convenience and may contain errors or incomplete information. They do not create a binding quote, appointment, warranty or contract. Only a price, service date or commitment confirmed by an Americare representative in writing or by phone is binding.
- Recording and data. Calls and chats with our AI tools may be recorded, transcribed and analyzed to provide the service, improve quality and keep records. Our use of this information is described in our Privacy Policy.
- No reliance for safety issues. Do not rely on an AI assistant for emergencies. If you smell gas, see smoke or sparks, or believe anyone is in danger, leave the area and call 911 and your utility provider first, then contact us.
- Limitation of liability. To the fullest extent permitted by law, Americare is not liable for errors, delays, misunderstandings or failures in AI-assisted communications, provided we act in good faith and correct material errors once we become aware of them.
7. Disclaimers, Limitation of Liability and Indemnification
Disclaimer. The Website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that the Website will be uninterrupted, secure or free of errors. Information on the Website is general and is not a substitute for a professional inspection of your equipment.
Limitation of liability. To the fullest extent permitted by law, Americare and its owners, employees and contractors are not liable for any indirect, incidental, special or consequential damages arising from your use of the Website or our services. Our total liability for any claim related to a service is limited to the amount you paid us for that service.
Indemnification. You agree to defend and hold harmless Americare from claims, losses and expenses, including reasonable legal fees, that arise from your misuse of the Website, your breach of these Terms, or your violation of any law or third-party right.
Nothing in these Terms limits any rights you have under applicable consumer protection laws that cannot be waived.
8. Governing Law, Changes and Contact
Governing law. These Terms are governed by the laws of the State of New York, without regard to conflict of law rules. Any dispute related to these Terms or the Website will be brought in the state or federal courts located in Westchester, New York, and you consent to their jurisdiction.
Changes to these Terms. We may update these Terms at any time. Changes take effect when posted on this page, and the effective date above will be updated. Continued use of the Website after a change means you accept the updated Terms.
Severability. If any part of these Terms is found unenforceable, the remaining parts stay in effect.
